These Terms of Service (“Terms”) govern your access to and use of the You Sing It platform, including our websites, applications, dashboards, artist pages, and related services (collectively, the “Platform”). In these Terms, “You Sing It,” “YSI,” “we,” “us,” and “our” refer to the platform operator.

By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who these Terms apply to

The Platform is used by different types of users, including:

  • Artists: creators who use the Platform to manage shows/events, song requests, fan lists, messaging/marketing, and payments/tips.
  • Fans: individuals who interact with artists, submit requests, and may send tips.
  • Admins: authorized users who manage parts of the Platform.

Some features may require creating an account and may depend on your plan/tier.

2. The Platform and what we provide

YSI provides tools that may include:

  • Artist profiles and public artist pages
  • Song requests and request management
  • Playlists and song libraries (subject to plan limits)
  • Event/show management
  • Fan contact collection and messaging/marketing tools (including email/SMS where enabled)
  • Subscription plans for artists with feature limits (for example, messaging limits, group limits, and media/storage limits)
  • Payment flows for tips and subscriptions (through third-party payment providers)

We may add, remove, or change features from time to time.

3. Accounts, eligibility, and security

You agree to provide accurate information, keep it current, and maintain the security of your account credentials. You are responsible for activity under your account.

You must comply with all laws applicable to your use of the Platform, including any laws related to payments, marketing communications, and consumer protection.

4. Subscriptions, billing, and refunds (Artists)

If you purchase a subscription:

  • Billing: subscription fees are billed in advance on a recurring basis (monthly or annually, as offered during checkout).
  • Auto-renewal: unless you cancel, your subscription renews automatically at the then-current price.
  • Cancellation: you can cancel at any time; your plan benefits typically remain available until the end of the current billing period.
  • No refunds by default: unless required by law or expressly stated at checkout or in a written policy from YSI, subscription fees are non-refundable and we do not provide prorated refunds for partial periods.

We may change subscription pricing or features for future periods; if required, we will provide notice through the Platform or via email.

5. Tips, payments, Stripe, and payouts

5.1 Payment processing

Payments on the Platform (including tips and subscriptions) are processed by third-party providers (for example, Stripe). Your use of those services is also governed by the provider’s terms and policies.

YSI does not store full payment card details; payment providers handle sensitive payment information.

5.2 How tips work on YSI (Stripe Checkout + payouts)

Fans start tips through YSI’s hosted Stripe Checkout. Tips may be one-time or, where offered, monthly recurring (managed in Stripe). Depending on whether the artist has linked an active Stripe Connect account at checkout, Stripe may process the charge as a platform payment to YSI’s Stripe account or as a direct charge on the artist’s connected Stripe account.

  • Processing fees may be deducted by Stripe; how fees are presented can depend on which checkout path applies.
  • YSI may collect a platform commission on tips (for example, based on an artist’s subscription tier, with a default rate where applicable), as reflected in the Platform and on tip details where available.
  • On platform charges, the artist’s net share may be paid out via Stripe (for example, a Connect transfer to the artist’s linked account). On direct Connect charges, YSI’s commission may be collected via Stripe application fees, and funds settle on the connected account per Stripe’s rules.
  • Payouts require an eligible linked payout account and can be delayed by verification, disputes, chargebacks, or provider holds.

5.3 Artist payout accounts

If you are an artist and connect a payout account (such as a Stripe Connect account), you authorize YSI and our payment providers to initiate transfers/payouts to that account according to the Platform’s settings and these Terms.

You are responsible for completing onboarding/verification and maintaining accurate payout and tax information.

5.4 Disputes and chargebacks

Fans may dispute charges or initiate chargebacks with their payment provider. Chargebacks and disputes can result in fees, reversals, and delays. To the extent permitted by law, you agree that YSI may pass through or offset amounts to cover chargebacks, refunds, disputes, or fees.

6. Fan conduct and requests

Fans agree to interact respectfully with artists and other users. You may not use the Platform to harass, threaten, or impersonate others, or to submit unlawful, defamatory, obscene, or infringing content.

Song requests are requests only. Artists control their performances and are not required to fulfill any request.

7. Artist responsibilities (content, marketing, and permissions)

Artists are responsible for how they use the Platform and for any content, messages, or campaigns they create or send through it, including compliance with applicable email and SMS laws and obtaining any required consent before messaging.

You represent that you have all rights and permissions needed for the content you upload and for any contact data you collect and use through the Platform.

8. User content and permissions you grant us

User Content” includes content you upload, submit, store, or send through the Platform (such as profile and branding assets, playlists, song files, event details, and messages). You retain ownership of your User Content. However, you grant YSI a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/technical delivery), display, and distribute your User Content solely to operate, maintain, and improve the Platform and to provide the features you choose to use.

9. Prohibited uses

  • Use the Platform for unlawful activities
  • Violate others’ rights (including privacy, publicity, intellectual property)
  • Attempt to access or probe systems or data you are not authorized to access
  • Interfere with or disrupt the Platform (including through abuse, scraping, or overload)
  • Reverse engineer the Platform except where prohibited by law
  • Use the Platform to send spam or unauthorized marketing communications

10. Third-party services and links

The Platform may integrate or link to third-party services. We do not control those services and are not responsible for their content, policies, or performance.

11. Intellectual property

YSI and our licensors own the Platform and all related intellectual property rights, excluding User Content. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Platform.

12. Termination and suspension

You may stop using the Platform at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, your use creates risk or potential legal exposure, or required by law or a payment provider.

13. Disclaimers

The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, YSI disclaims all warranties, express or implied.

14. Limitation of liability

To the fullest extent permitted by law, YSI will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless YSI from and against claims and expenses arising from or related to your use of the Platform or your violation of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform, by email, or as otherwise required by law.

17. Governing law

These Terms are governed by the laws of the jurisdiction where YSI operates, without regard to conflict of laws principles, unless applicable law requires otherwise.
